Visiting Scholars/Researchers

The University of Texas at El Paso (¶¶Òõ¶ÌÊÓÆµ) recognizes the value that visiting scholars and researchers bring to ¶¶Òõ¶ÌÊÓÆµ. Such visits foster collaboration, diversity, and professional relationships, enrich the academic environment, and enhance ¶¶Òõ¶ÌÊÓÆµ’s mission of excellence and innovation in teaching, research and community service.

¶¶Òõ¶ÌÊÓÆµ Faculty and Staff may invite qualified individuals to visit ¶¶Òõ¶ÌÊÓÆµ on a temporary basis to participate in scholarship activities or to perform research. Departments, centers, faculty, researchers, and administrators at ¶¶Òõ¶ÌÊÓÆµ who intend to invite or host visitors on a temporary basis should follow the guidelines and processes provided under ¶¶Òõ¶ÌÊÓÆµ Handbook of Operating Procedures (HOP), Sec. IV. Ch. 12: Visiting Scholars and Researchers.

This policy does not apply to potential Visitors who are a:

  • Guest visiting ¶¶Òõ¶ÌÊÓÆµ solely as a speaker or trainer,
  • ¶¶Òõ¶ÌÊÓÆµ employee (faculty and staff),
  • Faculty member receiving a Visiting Professor title listed in HOP policy Section 3, Chapter specifically 4.1.2.2.7, Academic Policies and Faculty Personnel Matters.
  • Registered ¶¶Òõ¶ÌÊÓÆµ student, or
  • Student participating in an organized educational program governed by another HOP policy

In addition, the government’s rules and regulations change frequently, and immigration and hiring processes can be highly complex. Please contact the Office of International Programs, at  (915) 458-8510 prior to initiating the invitation process. Short-term visitors may not be eligible under B-1 status (tourism, pleasure or visiting visa) if the individual:

  • Is a student or other non-professional (in most cases).
  • Will engage in collaborative research and/or teaching efforts.
  • Will be employed in the United States.
  • Will receive from ¶¶Òõ¶ÌÊÓÆµ, or some other U.S. funding source, any salary, wage, honorarium, stipend, or other form of compensation for services rendered.

Forms and Guidelines

These Guidelines are intended to assist Hosts and Host Units implement the requirements described in ¶¶Òõ¶ÌÊÓÆµ HOP, Sec. IV. Ch. 12: Visiting Scholars and Researchers, and follow related university procedures. Please refer to the HOP policy for the definitions of terms used in this document.

Guidelines

The following checklist includes the key components that should be included in your letter of invitation to support a Visiting Scholar/Researcher.

Invitation Checklist

The purpose of this form is to establish administrative approval of a Visiting Scholar/Researcher and must be submitted to the Office of Research Compliance & Regulatory Assurances at exportcontrol@utep.edu.

Screening Form

The Host Unit is responsible for the supervision of the Visiting Scholar/Researcher’s activities within the department for the entire duration of the visit. The Host unit may use this agreement to address issues related to the visit. The agreement form documents each of these specific, significant issues that the Host Unit must address (and the form captures the agreement of both the department and the Visitor for same), including but not limited to:

  • Description of activities and proposed timeline
  • Assumption of risk and waiver of liability
  • Granting facilities access
  • Use of equipment, supplies and services
  • Appropriate lab safety orientation, and other hazards
  • Intellectual property and confidentiality
  • Required health insurance
  • Compliance (Export Controls, Training, Conflict of Interests, etc.)

Visiting Scholar Agreement 

  • Visas are typically issued by the United States Department of State for specific activities. Be sure to review with the visitor what activities are contemplated. This is especially important for visitors from countries/regions subject to United States comprehensive sanctions.
  • International visitors do present a risk of a Deemed Export. Consider contacting the Export Controls Office (exportcontrol@utep.edu) early if you expect the visitor to be near or work with any of the following:
  1. Data that is not intended for the public domain (i.e. publication, seminars, etc.).
  2. Data with military or space applications.
  3. Controlled projects where publication is not allowable (i.e. for proprietary, government controls or other agreements).
  4. Projects where participation is limited by citizenship through a contract or other means.
  5. Technical data that are acquired through a non-disclosure/confidentiality agreement.
  6. Projects/areas/items associated with a Technology Control Plan (TCP).
